There are so many examples of discrimination that is, at the least, backed-up by the opinion of members of the administration. Sometimes it’s justified, even supported by them (Yoo ring a bell?). In this case I believe the connection is particularly illustrative, albeit appalling. I suppose that one of the necessary evils of democracy is protecting such officials’ speech free from criminal scrutiny, even in cases where causation can be established. Nevertheless, it’s equally essential for the better health of the system that links be traced and publicized.
